What is EB-2 NIW Visa?

The EB-2 NIW visa is an employment-based green card. It is issued to highly educated professionals (master's degree and above) or individuals with extraordinary ability in the sciences, arts, and business whose employment is in the national interest of the United States.

If you are applying under the Higher Education Holder category, you must meet at least one of the following 2 criteria:

  • Diploma and transcripts from a master's or advanced degree program
  • A bachelor's degree and transcripts plus at least five years of post-graduate work experience

If you are applying as a person of exceptional ability in the sciences, arts, or business, you must meet at least three of the following seven criteria:

How long do I have to wait until my EB-1 Green Card is approved?

The processing time for EB-1 Green Card applicants is much shorter than for other Green Card categories. This is largely due to the fact that you can file the petition on your own behalf and do not have to obtain a labor certification. The average processing time for an I-140 petition (Immigrant Petition for Alien Worker) is 4 months, based on data from the last 5 years. Depending on where you are located when applying for these visas, the processing time for change of status or consular applications varies from applicant to applicant.

Yes. Spouses and children under 21 years of age of EB-1 Green Card approved individuals can be in the United States in E-14/15 and E-21/22 status, respectively. This means that they are also granted permanent residency and work authorization. 

Can my child/children study in the USA?

Your child/children under 21 years of age can benefit from all the visa rights granted to you. As this gives them a permanent and legal residence permit, there are no obstacles to their participation in a part- or full-time study program.

Can I apply for EB-1A from a country other than the United States?

Yes, you can! Applicants who do not have legal temporary immigration status and who reside outside the U.S. may apply for an EB-1 Green Card through consular processing.
